my sister just recently recked my car and I had liability coverage but the lady hit my sister. My car is completly totaled, and my sister did'nt have a license only a permit. My car is paid off but now I am out of a car and have to buy another one can I file a claim with the other ladies insurance to get at least the blue book value of my car so I can buy another one or since my sister was driving do I have no rights and just *** out of a car.

As the owner, you can file a property damage claim against the other person's insurance. How much money you get will be based upon the liability and the state laws. Without knowing the facts of the accident, I will tell you most insurance companies will probably attribute at least some liability to your sister since she was unlicensed and would not be able to properly defensively drive.



I will also tell you that the Blue Book value is not what is used by Insurance Companies. The Blue book value is a national average for the vehicle, whereas insurance companies look at the locality (A BMW in Beverly Hills is worth more than a BMW in Montana).



I would suggest getting all the facts of the accident together and calling her insurance company to set up a claim through them.

If the other lady was at fault you need to file a claim with her insurance. If her company refuses to pay then you turn it into your insurance company which will go after the company and get the money from them. Providing you have full coverage on the vehicle.

Being that you had just liability, you will need to contact the other party's insurance company. Was there a police report? If so, get a copy. You can also call the other party directly to find out if they put a claim in yet and who you need to call.

You need to contact your insurance company to find out. Ther is no way we can tell you what your insurance company covers. It will depend on:



(1) the insurance company

(2) your policy

(3) the state where the accident happened



Call your insurance agent to find out. And remember, just because you call your agent doe NOT mean you are obligated to file a claim.

If your sister was driving legally you should be able to get some restitution. If she wasn't. I'm not so sure.
