The above llc has 1 full time employee (wife) who works more than 30 hours per week. I guess the owner and the spouse make the minimum numner (2) required for a small group. In this situation, can the llc post its owner/employee abroad to deliver the services for which this llc has obtained service agreements from foreign companies situated abroad?

It is possible in some states to structure a husband and wife as 2 separate employees to meet the minimum number of employees required in order to obtain group coverage.



I am not sure of the details of how Texas law works though so you will want to speak with an experienced TX health insurance agent.

Update: For a small group insurance eligibility the total number in the LLC who are willing to enroll for health insurance should be 2. Hence this question to check if the owner who is not exactly a full time employee, would he be counted in or he has to work for certain minimum number of hours in order to be eligible?



The second part of the question was to check that If the LLC's work requires the owner and the 1 employee to be posted abroad, does it affect the small group insurance eligibility?



Also, for HIPAA eligibility, is an employee of a LLC, as mentioned above, which offers a small group insurance, considered ok or one has to be an employee of a large group corporation only (employing more than 50 persons)?

OK, first of all, you're not going to get a true "small group" policy on two employees who are owner and wife. It will be individually underwritten and rated. Second, the health insurer is going to want to make sure the corporation has workers comp coverage in place for those employees, before they'll write health insurance.



Second, what the heck does the health insurance have to do with delivering foreign services?

Explain to me why anyone would want to hang out with you? My fiancee is a college student. I was not qualified for FASFA this year. I'll soon be informing my supervisors that I CAN work 40 hours per week, should they choose to raise the hours I already have. When and if you become qualified to attend college, you'll soon discover that it is IMPOSSIBLE to work full time while attempting to achieve a decent GPA, for most students. Unless you're Doogie Houser, I would bet that only 5% of any student in history has ever successfully maintained decent grades while devoting their time to any job. You know who I am, is that the impression of you I gather? Who's to say that I worked every job before my recent 4-month layoff at LESS than 40 hours weekly? If you've ever been to Whitehaven, a rest stop in Paducah, Kentucky sometime since September of 2008, congratulations, you've taken a dump in a toilet that I scrubbed ever so delicately for at least an hour, on night shift, at minimum wage, so that you may take a dump without flushing the john or keeping the tissue in the bowl, seeing as you are yet another disrespectful, self-entitled American, with NO respect for your fellow man. You want to keep telling us to find 40 hours per week in this recession? Why don't you move on to a more productive quest, such as finding a needle in a haystack, or a cigarette smoker who isn't destined for cancer.
